1. SCOPE AND ACCEPTANCE

Welcome to upstte.com. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Trevano Solutions S.R.L. ("we," "us," or "our") regarding your use of our website and purchase of products. By accessing our services, you confirm that you have read, understood, and agreed to these Terms, which comply with EU GDPR, the Digital Services Act (DSA), and EU Consumer Protection Law. If you do not agree, please discontinue use immediately.

2. ELIGIBILITY AND ACCOUNT MANAGEMENT

Eligibility: You must be at least 16 years old (or the minimum age as required by your Member State’s regulations) to use our services. Minors must be accompanied by a legal guardian.

Account Security: You are responsible for maintaining the confidentiality of your account credentials. We employ industry-standard security measures (encryption, access control) to protect your data. You must notify us immediately of any unauthorized access.

Account Cancellation: You may request account deletion at any time. Per GDPR, we will delete or anonymize your personal data within legal timeframes.

3. PRODUCTS, ORDERS, AND PAYMENT

Transparency: We clearly display all costs, including delivery fees, before checkout. No hidden charges are applied.

Order Confirmation: A binding contract is formed upon successful payment. We reserve the right to cancel orders due to inventory discrepancies or pricing errors, in which case a full refund will be issued.

Right of Withdrawal: Under EU Distance Selling Regulations, you have the right to withdraw from your purchase contract within 14 calendar days of receiving your goods without providing a reason.

4. COMPLAINTS & WARRANTIES

Legal Guarantee: In accordance with EU consumer protection laws, all products are covered by a 2-year legal guarantee of conformity from the date of delivery.

Quality Issues: If a product is defective or non-conforming, you have the right to request a repair, replacement, or price reduction. If repair/replacement is impossible, a refund may be issued.

Reporting: Please report any defective or damaged items within 30 days of delivery. Contact us at admin@upstte.com with your order number and photographic evidence.

Resolution Process: We acknowledge all complaints within 48 hours and aim to resolve issues within 14 days. We act in good faith to provide effective solutions for all legitimate quality claims.

5. USER BEHAVIOR NORMS

Users shall not:

Violate EU laws or distribute illegal/harmful content.

Engage in fraudulent transactions, "brushing" orders, or other unfair competition.

Infringe on our intellectual property (e.g., scraping our images or text).

Use minors' data for targeted advertising or unauthorized third-party sharing. Violations may result in restricted account access, account freezing, or legal action as per the DSA.

6. INTELLECTUAL PROPERTY

All content on this website—including images, text, logos, and code—is the property of Trevano Solutions S.R.L. and protected by EU intellectual property laws. Unauthorized reproduction or commercial use is strictly prohibited.

7. LIMITATION OF LIABILITY

We are not liable for service interruptions caused by force majeure (e.g., natural disasters, wars, government policy shifts) or third-party service failures (e.g., logistics/payment providers). Our total liability is limited to the purchase price of the product, except where prohibited by mandatory EU law.

8. DISPUTE RESOLUTION

Negotiation: Disputes should first be addressed through friendly negotiation.

Out-of-Court Settlement: If negotiation fails, you have the right to use certified EU out-of-court dispute settlement bodies. We commit to cooperating in good faith with these entities.

Jurisdiction: Disputes are governed by the laws of the EU Member State of your residence.
